In the AI landscape, technology is advancing faster than the law, which leaves many unanswered questions. Because of this, it’s best to avoid
using AI for work you would otherwise normally consider copyrightable. For example, your property descriptions used for public and private
remarks still must have a human “spark of creativity” to be eligible for copyright ownership under today’s standard. If you use a generative
AI model (like ChatGPT) to completely write and post your descriptions, it may result in loss of copyright protections which might otherwise
exist or open up the listing agent and/or brokerage to potential risks.
There are great advancements in AI development that will create new efficiencies, accuracy capabilities, and streamline disparate processes and data
sources in the real estate industry. However, AI remains in the early stages of development, so it is still best to exercise caution when using AI tools to
protect yourself and your clients.
